How Much Will a Hyland’s Products Lawsuit Cost?

How Much Will a Hyland’s Products Lawsuit Cost?

In a recent article I wrote about Hyland’s Products lawsuit, which was eventually settled out of court. The underlying facts are that Hyland’s Products marketed anti-aging facial cream and makeup designed to be worn at night. While on a business trip to New York, Hyland’s Managing Partner, Donald J. Trump suddenly became ill and missed his flight home. According to the article, Trump’s personal physician gave him the okay to travel and make any necessary purchases. Hyland’s Products did not respond to repeated requests for comment as to what caused this sudden bout of illness.

As is usually the case with litigation, it takes time and settlements to reach a point where a case can be brought to court. This particular lawsuit is being handled in New York, which is a plaintiff’s state. It is not uncommon for personal injury lawsuits to be filed in different states, such as Texas or Florida.

On the second day of trial before judge Richard E. Emini, and Associate Judge William J. Sibbs, a settlement was reached.

Details of the settlement were disclosed to the press by both sides. The amount was undisclosed. Mr. Sibbs recused himself, because he had been employed by Hyland’s Products while handling the case. The settlement essentially consisted of Mr. Sibbs agreeing to pay a small legal fee and to share some of the potential profits from the case.

There was much media coverage of this event. There were articles written regarding the settlement, as well as editorials in major newspapers throughout the United States. Some of this coverage was hostile, but there were others that were supportive. All in all, there appears to have been considerable public support for the injured parties.

The case ultimately was not lost. A week later, on April 8, Donald Trump’s attorney, John B.K. Barry brought the lawsuit before a federal court in Buffalo, New York.

He alleged that Hyland’s Products had falsely and fraudulently advertised its product as being made from “essential oils.” According to Barry, that was false and the company knew it. The company settled the suit the same day.

Donald Trump’s attorneys are now involved in the civil suit, which is expected to be resolved soon. The lawyers are trying to get the case moved on in a hurry, so that the damage to Mr. Trump’s reputation, and to the image of his company, are as little as possible. In addition to having to handle the damaging news coverage, they are also responsible for any other damage that may be done due to the controversy surrounding the case. And there is still the matter of the settlement.

So, what does all of this have to do with Mr. Trump?

The lawsuit was originally brought by Hyland’s Product’s Inc. His attorneys are attempting to get the case moved to California, where that company is based. California has often had favorable awards in product liability cases. And, they are often able to get a lot more than what is owed to Mr. Trump.

Other potential damages are also being considered. If a jury finds Hyland’s Products liable for all of the damages, Hyland could be looking at a huge financial payout. If, however, the case is settled out of court, then Hyland’s Products will only be responsible for the actual damages. They cannot be held responsible for punitive damages, like the one Donald Trump recently received, since those come under state law.

In recent years, attorneys’ fees have been growing quite comfortably.

In fact, they have become so comfortable, that many plaintiffs simply choose to drop the case and accept the money. But, that’s not what the law allows. And that’s why you should always consult a qualified personal injury lawyer if you think you may need one. It’s a smart choice that will prevent you from wasting your time and money on an endeavor that may ultimately fall through.

If you’re looking for a way to get the most possible compensation, it would be wise to consult an attorney as soon as possible.

While the attorneys won’t necessarily get paid unless the case is won, they will collect their share of the damages if the case goes to trial. And it will only be after the settlement that you will get your check. And, that’s usually how it works.

Now, let me say that a Hyland’s Products lawsuit is no laughing matter. It’s very serious business and should not be taken lightly. You want to make sure you’re getting the right amount of damages. So, get in touch with a good Hyland’s Products attorney as soon as possible to discuss your case.
