Recently, I’ve been asked about a Walmart lawsuits case that I believe is worth taking up and analyzing. In 2021, Trinakel became the center of a lawsuit involving injuries she received at one of Walmart’s stores in Arkansas. Her story and the facts of her case would provide much needed insight into the company’s policies and practices. Her attorney, Kevin Lyle, did an excellent job of representing her. At the time, however, Walmart was doing everything they could to avoid paying her damages.

So what exactly happened in this case?

Trinakel filed a complaint against Walmart with the US Equal Employment Opportunity Commission (EEOC). Her attorney, Kevin Lyle, and the Walton Family Corporation (owned by Walmart founder Bill Walton) were both named as parties in the lawsuit. Trinakel eventually settled with Walmart for an amount less than her attorney’s initial settlement offer. According to the details of the complaint, Trinakel was repeatedly propositioned by supervisors, who repeatedly inquired about her current salary and what she planned to do for supplemental income. She was also repeatedly offered free merchandise by Walmart, which she could not afford on her own.

The EEOC has been involved in quite a few class action lawsuits regarding the company’s policies regarding their employees.

In one case, they ruled that a store manager had intentionally placed employees in a dangerous work environment in order to get more money from the employer. In another case, they ruled that a vice president had falsely stated in his performance evaluations that he had never touched an employee’s butt during an altercation. In both of these cases, the EEOC was able to successfully argue that the employer had retaliated against the plaintiffs for filing the class action lawsuits. As I mentioned before, this is a very important part of proving a Walmart lawsuits, and it is always better to hire an attorney that specializes in this type of litigation.

The main problem with settlements like this is that often the corporation does not admit to having wrongfully acted towards their employees. Many times the corporation will offer what is called a “contingency fee” as a form of settlement when they have been found guilty of wrongfully harming their employees. Even if Walmart is found to have a liability over the incident, and has to pay damages, these large class action lawsuits usually will only pay a fraction of the original wage of the individual who was injured.

It is also important to remember that these settlements will only be paid if the case against the corporation has been successfully won by the individual who filed the lawsuit.

Rarely do these cases reach a judgment in the plaintiff’s favor, meaning that the settlements are often quite small. So in essence the money that is paid as a result of a Walmart lawsuit will often serve to pay for some of the attorney’s fees! This means that if you or someone you know has been wronged by Walmart you may not get the monetary compensation that you deserve!
